Hyderabad, July 19: The Supreme Court of India has turned its attention to the underlying motives behind the proliferation of private universities and the actual objectives of the institutions or individuals establishing them. It is also examining the educational qualifications of the faculty teaching at these universities.
After reviewing numerous complaints brought to its notice during the hearing of the Ayesha Jain vs. Union of India case, the Supreme Court ordered inspections of private universities across the country. Noting the arbitrary manner in which private universities often operate, the Court directed state governments to thoroughly inspect every aspect—ranging from the intent behind their establishment to the quality of education provided—and to submit affidavits containing comprehensive details.

In compliance with Supreme Court directives, the state government has appointed a committee, chaired by the Commissioner of Collegiate Education (CCE), to conduct inspections of private universities. The committee comprises the Secretary of the Telangana Council of Higher Education (TGCHE) as the Convener; the Registrar of JNTU as the Member-Convener; and the Registrar of Palamuru University, the Chief Finance and Accounts Officer of Osmania University, and the Assistant Director (Academic-C) from the Department of Technical Education as members.
The state government has also authorized the committee to appoint a subject expert if deemed necessary. This committee is visiting and thoroughly inspecting every private university in the state, focusing on the nine specific aspects mandated by the Supreme Court.

- INSPECTION COVERS 9 MAIN ASPECTS
The Supreme Court has directed that a comprehensive explanation be provided regarding nine specific aspects concerning private universities. The aspects for which the Supreme Court sought clarification are:
- Why was the university established in the first place? What were the reasons and objectives behind its establishment? 1. Was a feasibility study conducted prior to the establishment of the university? Were any policy considerations undertaken before its establishment?
- Did the state government allocate any land to the university? What other benefits were extended to the university, and what terms and conditions were imposed in relation to them?
- What is the objective of the society, organization, or individual actually managing the university? Who are the members of the university’s management committee, and how were they selected? Please provide comprehensive details regarding the individual actually managing the university and the members of the management committee.
- What procedure is followed for student admissions? What are the standards and regulations regarding the entrance process, and are they in compliance with the law? Did the state government review and validate the modalities concerning the entrance process?
- How did the university recruit its teaching (academic) staff? Which committee handled the selection process? Were the staff appointments made in accordance with UGC regulations? Did the state government validate the recruitment process?
- Has the government constituted an inspection team to ensure that these universities strictly adhere to the regulations and conditions imposed on other educational institutions and universities in the state? If so, does the team conduct inspections? Are inspections carried out regularly? Does the inspection team monitor the implementation of regulations? Have any violations of regulations been identified? Have any actions been taken in cases of non-compliance? Has the government granted any exemptions?
- Are the universities that declared themselves to be operating on a ‘no-profit, no-loss’ basis actually functioning in that manner? Under what authority did the government permit this? How was it verified that university funds were not diverted—including for salaries and other expenses paid to the founder and their family members, or for the acquisition of assets? Have the accounts of these universities been audited? Has the issue of fund diversion been examined? Have the payments made to the founder and their family members been scrutinized? Have the assets acquired by the founder and their family members been examined? Have any violations of regulations been identified? If so, what actions were taken?
- Is there a system in place at the university to address grievances from both students and teaching staff? If so, is it functional? What is the composition of the grievance redressal committees? Is there a provision for appeals? Have any grievances been received so far? If received, have they been resolved?
- Are the universities paying the minimum wages prescribed by law to their academic staff? Has the implementation of UGC regulations been verified? Have the staff salary records been examined? Were any violations of regulations identified during this process? If so, was any action taken?
In accordance with Supreme Court directives, an inspection team is examining these aspects across private universities in the state and preparing a comprehensive affidavit containing the details. The state government will submit this affidavit to the Supreme Court. Following the submission, the state government will initiate further action based on the Supreme Court’s orders. Additionally, the inspection team will thoroughly examine these nine points along with other relevant matters and prepare a report.
